Nothing in these Terms and Conditions affects any mandatory rights you may have under Cyprus or European Union consumer protection law where you act as a consumer and not in the course of a trade or profession.

In the event of any conflict between these Terms and Conditions and mandatory provisions of Cyprus or European Union law, the mandatory legal provisions will prevail.

4. Eligibility and account registration

To place orders on the website you must:

  • Be at least eighteen years old and have legal capacity to enter into contracts.
  • Provide accurate and complete information when registering an account or placing a guest order.
  • Ensure that any account credentials are kept confidential and not shared with unauthorised persons.

You are responsible for all activities that occur under your account. If you believe your account has been compromised, you must inform BYRED without delay.

BYRED reserves the right to suspend or terminate accounts that are used in breach of these Terms and Conditions, used fraudulently, or used in a way that may cause harm to BYRED or third parties.

Information about products, including descriptions, ingredients, usage instructions and suitability, is provided on the relevant product pages on the website.

BYRED aims to ensure that product information is accurate and up to date but does not guarantee that any description, photograph or other content is free from minor errors or is perfectly representative of the delivered product. Colours, packaging and minor details may differ slightly from images shown on the website.

If a product is materially different from its description, you may have rights to a remedy under the section on defective products in these Terms and Conditions and under applicable consumer law.

All products offered are subject to availability. BYRED does not guarantee that any product will be in stock at any particular time.

6. Prices, taxes and errors

All prices displayed on the website are shown in euro and, unless stated otherwise, include applicable value added tax in Cyprus.

Delivery charges and any additional fees are shown separately during the checkout process before you confirm your order.

BYRED takes reasonable care to ensure that prices shown on the website are correct. However, pricing errors may occur. If BYRED discovers an obvious pricing error after you have placed an order, BYRED will inform you as soon as reasonably possible and give you the option to reconfirm the order at the correct price or to cancel it. If BYRED is unable to contact you, the order will be treated as cancelled and any amounts paid will be refunded.

7. Ordering process and contract formation

You can place an order by adding products to your basket and following the checkout steps on the website. During checkout you will be asked to confirm your delivery address, review your order, and choose a payment method.

Before submitting your order, you must carefully check all details including products, quantities, prices and delivery address. You are responsible for the accuracy of the information you provide.

Once you submit your order, you will receive an email acknowledging receipt of your order. This email is an acknowledgement only and does not constitute acceptance of your order.

A binding contract between you and BYRED is formed only when BYRED sends you an order confirmation email or otherwise confirms dispatch of the products. BYRED reserves the right to decline or cancel any order prior to dispatch, including for reasons such as product unavailability, payment issues, suspicion of fraud or breach of these Terms and Conditions.

8. Payment

Payment for orders placed through the website can be made using the methods offered at checkout, which currently include online card payments through the JCC payment gateway, bank transfer and cash on delivery.

When you pay by card through JCC, your payment details are processed securely by JCC in accordance with their terms and security standards. BYRED does not store full card details on its own systems.

When you choose bank transfer, payment instructions will be provided at checkout or in your order confirmation. Your order may not be processed or dispatched until BYRED has received cleared funds.

For cash on delivery, you must pay the full order amount and any applicable delivery charges to the courier or BYRED personnel at the time of delivery.

By submitting payment information, you confirm that you are authorised to use the selected payment method.

9. Delivery

BYRED delivers products only within Cyprus. Orders are delivered either by BYRED personnel or through third party courier services.

Applicable delivery options, estimated delivery times and delivery charges are presented during checkout. A separate Delivery Policy on the website provides further details about delivery methods, shipping fees and timeframes, and forms part of these Terms and Conditions.

BYRED will make reasonable efforts to deliver products within the indicated timeframes. However, delivery times are estimates and not guaranteed. Delays can occur for reasons beyond BYRED’s reasonable control, such as courier delays, weather conditions, public holidays or other events.

If BYRED becomes aware of a significant delay, BYRED will inform you and, where permitted by law, offer you the option to continue waiting for the product or to cancel the order with a refund.

You must ensure that the delivery address provided is correct and that someone is available to receive the products. If delivery fails due to inaccurate address information or because there is no one to receive the products, additional redelivery costs may apply.

10. Transfer of risk and ownership

Risk in the products passes to you when the products are delivered to the delivery address you provided or when you or a third party designated by you physically receives them, whichever occurs first.

Ownership of the products passes to you only when BYRED has received full payment of all sums due in respect of the products, including delivery charges.

11. Right of withdrawal, returns and refunds

BYRED offers a contractual thirty day return period from the date you receive the products, subject to the conditions described in the Refund and Cancellation Policy available on the website. That policy forms an integral part of these Terms and Conditions and applies to all returns and cancellations.

In summary, returns are generally accepted within thirty days provided that products are unopened, sealed and in their original packaging in a condition suitable for resale, that you pay the return shipping costs for non defective returns, and that BYRED refunds the full product price plus the original shipping cost once the return is accepted.

If you are a consumer within the meaning of Cyprus and European Union consumer law, you benefit in any case from a statutory right to withdraw from most distance contracts within fourteen days from delivery without giving any reason, and this statutory right is not limited by the contractual thirty day period offered by BYRED.

The detailed terms, conditions, exclusions and procedures for returns, cancellations and refunds are set out in the Refund and Cancellation Policy. In the event of any conflict between a summary in these Terms and Conditions and that policy, the policy shall prevail.

12. Defective products and legal guarantees

BYRED is under a legal obligation to supply products that conform to the contract. If a product is defective, damaged or does not match its description, you may be entitled to repair, replacement, a price reduction or a refund under Cyprus consumer protection legislation and the European Union rules on the sale of goods.

If you believe a product is defective or non conforming, you must notify BYRED as soon as possible after becoming aware of the issue, ideally with supporting photographs and a description of the problem. BYRED will assess your claim and, if appropriate, arrange for the product to be returned at BYRED’s expense, and provide the appropriate remedy.

The statutory guarantee period is generally two years for new consumer goods, subject to the conditions and exceptions set out in the applicable legislation. This statutory guarantee exists in addition to, and not in place of, any contractual return rights you may have under the Refund and Cancellation Policy.

13. Use of the website

You agree that you will not use the website:

  • For any unlawful purpose or in breach of any applicable law.
  • To submit or transmit any material that is defamatory, offensive, infringing, harmful or otherwise inappropriate.
  • To interfere with or disrupt the operation or security of the website, servers or networks.

  • BYRED will not be liable for any loss of profit, revenue, business opportunity, goodwill or anticipated savings.
  • BYRED will not be liable for any indirect or consequential loss or damage.
  • For business customers, BYRED’s total liability in respect of any claim arising out of or in connection with a contract for the sale of products shall not exceed the total amount paid by you for the products concerned.

BYRED will not be responsible for any failure or delay in performing its obligations where such failure or delay is caused by an event beyond its reasonable control, including but not limited to acts of God, war, terrorism, strikes, industrial disputes, natural disasters, pandemics, interruption of utilities or failure of telecommunications networks.

This limitation of liability does not affect any rights you may have as a consumer under mandatory consumer protection law.
